Applied Products Inc. 12- Month Limited Warrant

Applied Products Inc. (“Applied Products”) warrants to the initial Purchaser that its adhesive and sealant dispensing systems listed below (“Products”) are free from material defects in material and workmanship for a period of twelve (12) months from the date of initial installation of the Products or a period of eighteen (18) months from the date of original delivery of the Products to the initial purchaser, whichever occurs first.  The warranty period may be extended if expressly agreed to by Applied Products in writing.  

For purposes of this Limited Warranty, “Purchaser” shall mean the entity listed on the applicable purchase order, and “Delivery Date” shall mean the date on which the Product is first delivered by Applied Products to the initial Purchaser (i) at the location identified on the purchase order and/or invoice or otherwise agreed to by Applied Products in writing, or (ii) at Applied Products’ facility if purchaser takes possession of the Product at Applied Products’  facility, and shall not mean a later date when the Product may be transported by the Purchaser to a site where it is first used.  

Products Covered By This Limited Warranty 

This Limited Warranty applies only to Products manufactured by under the following brand names: 

  • AST 
  • Keystone 
  • Dispense Technologies 
  • AS365 
  • Axco  
  • Applicator Systems  
  • HG Adhesive Dispensing
  • Lubie Lube  

Limited Warranty Coverage 

If, after inspecting the Product, Applied Products determines in its sole and exclusive discretion that Purchaser has a valid warranty claim based on the terms set forth in this Limited Warranty, Applied Products in its sole and exclusive discretion will: 

  • Repair the  Product, 
  • Replace the Product with an equivalent or updated model, or 
  • Refund the original purchase price, 

provided that the Product has been properly installed, operated, and maintained in accordance with Applied Products’ written recommendations and instructions. 

Any repair of Products under this Limited Warranty, or otherwise, will not extend the warranty period of the equipment subject to such repair. The components used in repair will have their designated manufacturer warranty time frame honored. 

Limited Warranty Exclusions 

This Limited Warranty does not cover and Applied Products shall not be liable for: 

  • Consumables (filters, lubricants, nozzles, and similar products); 
  • Normal wear and tear; 
  • Damage or failure resulting from or related to: 
  • Improper installation, misuse, abuse, negligence, or accident; 
  • Acts or omissions of any person or entity other than Applied Products or an Applied Products authorized representative; 
  • Use of materials or substances not specified or approved by Applied Products; 
  • Inadequate or improper maintenance, storage, use, assembly, or failure to follow operating instructions; 
  • Substitution with or use of non-Applied Products’ parts or components; 
  • Unauthorized modification, alteration, or repair; 
  • Malfunction or damage caused by incompatibility with accessories, structures, or equipment not provided or approved by Applied Products; and 
  • Disaster (e.g., fire, flood, wind, freezing) or other causes beyond the control of Applied Products. 
  • Failure to use the Products in accordance with applicable good safety practices, regulations, instructions and warnings will void the warranty coverage and could create risk of serious injury or death. 

Warranty Claims Procedure 

To initiate a claim under this Limited Warranty, Purchaser must provide written notice of Purchaser’s potential warranty claim to Applied Products within three (3) business days of the date Purchaser discovers or should have discovered the product issue underlying a potential warranty claim.  Notice of the potential warranty claim shall be made as follows: 

  1. Contact APPLIED PRODUCTS by email at RMARequest-PSE@Applied products.com;
  2. Provide a copy of the original reference number (Sales Order, PO number, etc..); and 
  3. Describe with specificity the issue with the Product. 

Once notice of the potential warranty claim is received, you will be provided with a Return Material Authorization (RMA). Unless otherwise stated by Applied Products in writing, the Product must be returned for inspection at the Purchaser’s expense.  If in its sole discretion Applied Products determines a valid warranty claim exists, Applied Products will, at its sole discretion, repair or replace the Product at no charge and return it to the original Purchaser with transportation prepaid, or refund the original purchase price. 

If Applied determines that the warranty claim is not proper, any repairs will be made at a reasonable charge, including parts, labor, and shipping. However, these repairs will only proceed after a written quote has been provided and the purchase order (PO) has been approved by the original Purchaser. 

If a replacement part is needed before evaluation has been completed, customer will need to issue a PO for the replacement part, if part is found to be covered under warranty, no invoice will be issued against the warranty.  

Limitation of Liability 

THIS LIMITED WARRANTY AND THE REMEDIES DESCRIBED ABOVE ARE THE EXCLUSIVE REMEDIES.  IN NO EVENT, WILL APPLIED PRODUCTS’ LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT.  APPLIED PRODUCTS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, PUNITIVE, OR INCIDENTAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR DELAYS, LOSS OF PRODUCTION, LOSS OF PROFITS OR REVENUE, LOST BUSINESS, OR BUSINESS INTERRUPTION.  

UNDER NO CIRCUMSTANCES WILL APPLIED PRODUCTS BE LIABLE TO PURCHASER, OR ANY OTHER PERSON, FOR PERSONAL INJURY OR PROPERTY DAMAGES OF ANY KIND. 

APPLIED PRODUCTS OFFERS NO OTHER WARRANTIES ON THE PRODUCT BEYOND THOSE SET FORTH IN THIS LIMITED WARRANTY.  NO OTHER WARRANTY, ORAL OR WRITTEN, IS AUTHORIZED TO BE GIVEN OR HAS BEEN GIVEN BY ANY AUTHORIZED REPRESENTATIVE OF APPLIED PRODUCTS TO PURCHASER.  

APPLIED PRODUCTS DISCLAIMS ALL WARRANTIES FOR PRODUCTS UNITS THAT ARE PURCHASED FROM SELLERS OTHER THAN APPLIED PRODUCTS. 

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL IMPLIED WARRANTIES ARE EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. IN PARTICULAR, APPLIED PRODUCTS MAKES NO WARRANTY REGARDING THE MERCHANTABILITY OF THE PRODUCT OR ITS SUITABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, AND DISCLAIMS ANY OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, REGARDING THE PRODUCT INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND IMPLIED WARRANTIES ARISING FROM A COURSE OF DEALING OR COURSE OF PERFORMANCE. 

This Limited Warranty gives Purchaser specific legal rights, and Purchaser may also have other rights which vary from state to state.  

This Warranty is not transferable. 

Applied Products’ sole obligation is to the original Purchaser and the original Purchaser’s sole remedy shall be limited to the repair, replacement, or refund as provided herein.  

Governing Law 

This warranty shall be governed by and construed in accordance with the internal laws of the State of Minnesota, without regard to its conflict of law principles.
